Terms & Conditions
Last Modified: October 15, 2026
Welcome to austincoins.com (the “Website”), operated by Austin Rare Coins, Inc., a privately held Texas corporation (“Austin Rare Coins,” “we,” “us,” or “our”). These Terms & Conditions (these “Terms”) govern your access to and use of the Website, including our blog, FAQ, newsletter archive, and other content, features, and services offered on or through the Website, and all purchases, sales, and other transactions between you and Austin Rare Coins, whether made through the Website, by telephone, by email, or in person (each, a “Transaction”).
PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION AND CLASS ACTION WAIVER IN SECTION 32 THAT REQUIRE THE USE OF INDIVIDUAL ARBITRATION TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, AND A LIMITATION ON THE TIME TO BRING CLAIMS IN SECTION 30.
1. Acceptance of These Terms
By accessing or using the Website, creating an account, placing an order, or entering into any Transaction with us, you agree to be bound by these Terms, our Privacy Policy, and any additional policies and/or guidelines posted on the Website, each of which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Website or enter into any Transaction with us.
By using the Website or entering into a Transaction, you represent and warrant that you: (a) are at least 18 years of age and able to form a binding contract; (b) are located in the United States; (c) are not located in a country subject to a U.S. government embargo and are not listed on any U.S. government list of prohibited or restricted parties; and (d) will comply with these Terms and all applicable laws.
2. Changes to These Terms
We may revise these Terms from time to time. Revised Terms will be posted on the Website with an updated “Last Modified” date and will apply prospectively to your use of the Website and to Transactions entered into after the revised Terms are posted. Changes will not apply to any Transaction completed before the change is posted, and changes to Section 32 will not apply to any dispute of which the parties had actual notice before the change was posted. If we make material changes, we will provide notice through the Website or by email and may ask you to accept the revised Terms before your next purchase or login. Your continued use of the Website after revised Terms are posted constitutes your acceptance of the revised Terms. We may modify, suspend, or discontinue all or any part of the Website at any time without notice.
3. Privacy
Our Privacy Policy, which is located at www.austincoins.com/privacy-policy, describes how we collect, use, and share personal information, including information collected through cookies and similar technologies, information related to your orders and mobile messaging, and the choices and rights available to you. By using the Website or entering into a Transaction, you acknowledge that your information will be handled as described in the Privacy Policy.
4. Accounts
If you create an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your username and password, for all activity under your account, and for notifying us immediately at [email protected] of any unauthorized use of your account. We may suspend or disable any account at any time if we believe you have violated these Terms.
5. Electronic Communications
By using the Website, creating an account, or entering into a Transaction, you consent to receive communications from us electronically, including order confirmations, invoices, notices, disclosures, and other communications relating to your Transactions and these Terms, and you agree that these electronic communications satisfy any legal requirement that such communications be in writing. Pursuant to the Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.), you may withdraw this consent or request a paper copy of any electronic communication by contacting us; withdrawing consent may prevent us from completing Transactions with you. To receive electronic communications, you need a device with internet access and a valid email address. Your choices regarding marketing emails are described in our Privacy Policy.
6. Intellectual Property; Limited License
The Website and its entire contents, features, and functionality, including all text, articles, blog posts, FAQs, market commentary, price data compilations, photographs of coins, graphics, logos, videos, software, and the design, selection, and arrangement of the foregoing (collectively, “Materials”), are owned by Austin Rare Coins or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. “Austin Rare Coins,” “Austin Rare Coins & Bullion,” our logos, and all related names, designs, and slogans are trademarks of Austin Rare Coins. All other names, logos, and marks on the Website (including grading service marks) are the property of their respective owners.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial use and to shop for, purchase, or sell coins and bullion with us. You may view, print, or download a reasonable number of pages for your personal, non-commercial use, provided you keep all copyright and other proprietary notices intact, and you may use any social media sharing features we make available as they are provided. Except as expressly permitted, you may not copy, reproduce, modify, distribute, republish, publicly display, create derivative works from, or commercially exploit any Materials without our prior written consent.
You may not use any robot, spider, scraper, deep-link, or other automated or manual means to access, monitor, copy, data mine, or extract any portion of the Website or Materials (including pricing data or coin images), or use the Website or Materials to develop, train, or improve any software, algorithm, or artificial intelligence or machine learning model, without our prior written consent. All rights not expressly granted are reserved.
7. Blog, FAQ, and Other Website Content
Our blog, FAQ, newsletter archive, market price information, and other Website content are provided for general informational and educational purposes only. They are not investment, financial, tax, or legal advice, and they are not a recommendation to buy or sell any particular coin or bullion product. Market data displayed on the Website may be delayed or inaccurate and are not an offer to buy or sell at that price. Content may be out of date, and we are not obligated to update it. Some content may be provided by third parties, such as guest authors, industry sources, or grading services; statements and opinions in that content are solely those of their authors and do not necessarily reflect our views. Any reliance you place on Website content is at your own risk. You should consult your own financial, tax, and legal advisors before making any purchase or sale decision.
8. User Content and Feedback
If you submit questions, suggestions, feedback, photographs, or other content to us by email or through forms on the Website (“User Content”), you grant Austin Rare Coins a perpetual, irrevocable, royalty-free, non-exclusive, transferable, sublicensable license to use, reproduce, modify, publish, distribute, and display that User Content in any media, including for marketing and promotional purposes. You represent and warrant that you own or have the rights necessary to grant this license and that your User Content does not infringe or violate the rights of any third party. We may use your User Content without compensation or attribution to you.
9. Prohibited Conduct
You agree that you will not: (a) use the Website for any unlawful purpose or in violation of these Terms; (b) provide false, inaccurate, or misleading information, including in connection with any order, payment, or sale of coins to us, or use a payment method you are not authorized to use; (c) impersonate any person or entity or misrepresent your affiliation with any person or entity; (d) upload or transmit any viruses, malware, or other harmful code; (e) attempt to gain unauthorized access to, interfere with, damage, or disrupt the Website, its servers, or any connected systems, including through denial-of-service attacks or by bypassing security, bot-detection, or access controls; (f) probe, scan, or test the vulnerability of the Website without our written authorization; (g) transmit spam, chain letters, or other unsolicited commercial communications; (h) frame, mirror, or republish any part of the Website; (i) use our trademarks or the names of our personnel as metatags, keywords, or in any manner that suggests a false affiliation with or endorsement by us; (j) post or transmit any material that is defamatory, obscene, harassing, threatening, fraudulent, or infringing; (k) exploit or harm minors in any way; or (l) take any action that imposes an unreasonable load on our infrastructure. Your license to use the Website terminates automatically if you violate any of these restrictions.
10. Third-Party Links, Affiliate Links, and Third-Party Services
The Website, including our blog, FAQ, and newsletters, may contain links to third-party websites and resources. Third-party links are provided for your convenience only. We do not control, endorse, or make any representation or warranty about any third-party website, product, or service, and we are not responsible for its content, accuracy, availability, or privacy practices, or for any loss or damage arising from your use of it. Your use of any third-party website, product, or service is at your own risk and subject to that third party’s terms and privacy policy.
The Website also uses third-party services, including payment processors and security tools. Your use of those services may be subject to the third party’s own terms and privacy policy. For more information about the third parties with which we share information, please see our Privacy Policy.
11. Social Media
The Website contains links to our accounts on third-party social media platforms, such as Instagram, YouTube, X (formerly Twitter), and TikTok, and may include sharing or other social media features. Your use of those platforms is governed by the platforms’ own terms of use and privacy policies, not these Terms, and we are not responsible for the platforms or their practices. We may remove comments on our accounts and may disable any social media feature at any time without notice.
12. Copyright Complaints
We respect the intellectual property rights of others. If you believe that material on the Website infringes your copyright, please send our designated copyright agent a notice that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and where it is located on the Website; (d) your address, telephone number, and email address; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf. Notices should be sent to: Kristy Britcher, Austin Rare Coins, Inc., 13809 Research Blvd, Suite 405, Austin, Texas 78750, [email protected]. We may terminate the accounts of repeat infringers.
13. Monitoring, Suspension, and Termination
We are not obligated to monitor the Website, but we may investigate and take any action we consider appropriate in response to any suspected violation of these Terms, including suspending or terminating your access to the Website or your account, refusing or cancelling orders, and cooperating with law enforcement. We may disclose information about you as described in our Privacy Policy, including when we believe disclosure is necessary to comply with law or legal process, to investigate fraud, or to protect our rights, property, or safety or those of others.
14. Geographic Restrictions
The Website is operated from the State of Texas and is intended for use only by persons located in the United States. We make no representation that the Website or any products are appropriate or available for use outside the United States. We sell and ship only to addresses in the United States.
15. Ownership
Austin Rare Coins is a privately held corporation formed in 1989 under the laws of the State of Texas. We are not affiliated with the United States Government or any government agency. Information about how we collect, use, and share your personal information is available in our Privacy Policy.
16. Selection
Austin Rare Coins is always prepared to assist you in selecting coins for your portfolio or collection. You understand, however, that the decision to purchase coins, and which coins to purchase, is ultimately yours alone.
17. Orders; Verification and Acceptance
All orders are subject to approval and final verification by Austin Rare Coins. An order is accepted only when we confirm it by email, by invoice, or by telephone confirmation. We may refuse, limit, or cancel any order. If we cancel an order after payment has been made, we will refund the amount paid. We will attempt to notify you using the contact information provided with your order if we change or cancel your order.
18. Pricing and Product Information
Prices on the Website, including precious metal prices, change frequently with market conditions and may change without notice. The price of your order is the price we confirm when we accept your order. Coin photographs may be representative images or may not reflect the exact coin you receive unless the listing states otherwise, and descriptions, images, and prices may contain errors. We may correct any error at any time, including after an order has been submitted, and may cancel any order affected by an error. You are responsible for any applicable sales, use, or other taxes, which we will collect where required by law.
19. Payment
We accept credit and debit cards (Visa, Mastercard, American Express, and Discover), Google Pay, Apple Pay, personal checks, and bank wires, or as otherwise set forth by us. Payments made through the Website are processed by our third-party payment processors and may be subject to their terms. We do not ship an order until payment has been received in good funds, and orders paid by personal check will be held until the later of (i) seven business days after we receive the check or (ii) the date the check clears.
(a) Matching Address. On all credit card orders, the shipping address and billing address must match.
(b) First-Time Order Limit With Credit Card. We have a strict limit for first-time clients using a credit card of $2,750. If you would like to place a larger order, call us at 1-800-928-6468 and speak to one of our advisors to pay by personal check or bank wire.
(c) Payment Deadline for Large Orders. For orders totaling more than $10,000, payment must be received within 48 hours after we confirm your order. If payment is not received by that deadline, you will be charged a late fee of 1.5% of the order total (or, if less, the maximum amount allowed by applicable law), and we may cancel your order.
(d) Cancellation or Nonpayment; Market Loss. If you cancel or fail to pay for a confirmed order, you are responsible for any market loss we incur, which is the amount by which the confirmed price of your order exceeds the price at which we resell or otherwise dispose of the coins. You may pay any market loss by credit card or by any other payment method we accept.
20. Shipping; Title and Risk of Loss
Shipping methods, timing, and costs are described on our Shipping Policies Information, which is located at www.austincoins.com/customer-service/. Shipment of bullion orders is normally accomplished within 7-14 days of funding unless you are advised otherwise of unusual market conditions in effect at the time of the sale. Shipping dates are estimates only. Title to and risk of loss of the items you purchase pass to you upon delivery of the items to the shipping address specified in your order.
21. Numismatic Return Privilege
You may return any numismatic coins you order from us in their original holders, within 14 days of receipt for a full refund, unless you are otherwise notified at the time of the sale. Carefully inspect and evaluate your coins during this period. To receive a refund or exchange, you must return your numismatic coin order to Austin Rare Coins, registered and insured via the U.S. Postal Service, in the same condition as when shipped, within 14 days of receipt.
22. Bullion Coins Non-Returnable
Coins we categorize as “bullion” are not subject to return or exchange. Sales of all such bullion coins shall be final.
23. Grading & Authenticity; Disclaimer of Warranties
Grades and descriptions of rare coins are opinions, not statements of fact or guarantees, and are based on standards and interpretations that can and do change over time. Austin Rare Coins uses contemporary grading standards and interpretations to grade coins and relies upon opinions of independent grading services such as the Professional Coin Grading Service, the Numismatic Guaranty Corp., and ANACS. Each of these grading services is recognized by the coin industry for its expertise. Each firm guarantees the grade and certifies each coin to be authentic. Austin Rare Coins relies upon those guarantees in selling coins. HOWEVER, WE DO NOT GUARANTEE THAT THE COINS WE SELL WILL ACHIEVE THE SAME GRADE FROM ANY INDEPENDENT GRADING SERVICE IN THE FUTURE, AND WE EXPRESSLY DISCLAIM ANY OTHER WARRANTIES WITH RESPECT TO THE COINS, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
24. Selling Coins to Us; Bid Price
If you wish to sell your coins in the future, Austin Rare Coins encourages you to offer them to us first. We cannot guarantee to make a bid on every coin or that our bid will equal or exceed that of other coin dealers. By offering coins to us, you represent and warrant that you own the coins free and clear of all liens and claims and have the right to sell them.
25. Rare Coin Market Risks and Disclosures
(a) Volatility. The coin market is volatile and thinly capitalized and therefore subject to substantial fluctuations including significant and rapid increases and decreases in value from time to time. Investors must be able to assume the risk of such price fluctuations. For that reason, rare coins are not a suitable investment for everyone.
(b) Investment Potential. During the period since 1970, in which relatively accurate statistics have been maintained, many rare coins have shown an excellent record as appreciating assets. The past performance of coins is a guide, not a prediction, of future events. In addition, many coins are bought, sold, and traded by the collector community without regard to investment potential.
(c) Regulatory Environment. The purchase, sale, and ownership of rare coins and precious metals may be subject to federal, state, and local laws, including tax, reporting, identity verification, and anti-money-laundering requirements, and those laws may change over time. We may be required to collect information from you or report certain Transactions to government authorities. There is no guarantee that future laws or regulations will not adversely affect the value, liquidity, taxation, or reporting of rare coins. You are solely responsible for determining and satisfying any tax obligations arising from your Transactions.
(d) Economic Forces. The success of an investment in rare coins is dependent, at least in part, upon extrinsic economic forces including supply, demand, international monetary conditions, and inflation or the expectation of inflation. The impact of these forces on the value of coins cannot be predicted with any certainty. No assurance can be given that an investor will be able to sell his or her coins at a price greater than or equal to their acquisition cost. Further, rare coins are not suitable investments for investors seeking current income.
(e) Austin Pricing. Because of expenses associated with the acquisition and sale of rare coins, which are not involved in other investments, the gross margins charged by a coin dealer are typically higher than those associated with some other investments. Therefore, rare coins should be considered as long-term investments. However, there is no guarantee that the holding of a coin, for any period, will result in appreciation.
(f) Representations. Information and statistics used in the preparation of Austin Rare Coins advertising materials, letters, and oral presentations are derived from industry sources that we believe to be reliable. Any statements or predictions by our staff are opinions only, not statements of fact. Remember that market conditions are subject to change without notice and no guarantee of accuracy is either expressed or implied.
(g) No Advice. Austin Rare Coins is a coin and precious metals dealer. We are not an investment adviser, broker-dealer, financial planner, tax advisor, or attorney, and nothing on the Website or in our communications with you is investment, financial, tax, or legal advice.
26. SMS Program Terms
By providing your mobile phone number to us either verbally during a phone consultation or by entering it on the Website with the accompanying SMS-consent disclosure, you agree to receive recurring SMS messages from us related to your order. These messages include: (a) secure payment links so you can complete payment; and (b) shipping and delivery status updates. We do not send marketing or promotional messages through this program. Consent is not a condition of purchase. Message frequency varies based on the number of orders you place. Message and data rates may apply, based on your mobile carrier plan.
You can opt out at any time by replying STOP to any message; you will receive one final confirmation, and no further messages will be sent. Reply HELP to any message for assistance, or contact us at 1-800-928-6468 or [email protected]. Carriers are not liable for delayed or undelivered messages.
Your mobile information will not be sold or shared with third parties for promotional or marketing purposes; it is shared only with the service providers necessary to operate the program, such as our SMS delivery vendor and mobile carriers.
27. Website Disclaimer
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL MATERIALS, INFORMATION, AND CONTENT AVAILABLE ON OR THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION YOU TRANSMIT TO US WILL BE SECURE FROM UNAUTHORIZED ACCESS. WARRANTIES RELATING TO COINS ARE ADDRESSED EXCLUSIVELY IN SECTION 23. THIS SECTION DOES NOT AFFECT ANY WARRANTY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
28. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AUSTIN RARE COINS OR ITS AFFILIATES, OR ITS OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS (THE “AUSTIN RARE COINS PARTIES”) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST OPPORTUNITY, OR LOSS OF ANTICIPATED APPRECIATION, ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR ANY TRANSACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE AUSTIN RARE COINS PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR ANY TRANSACTION WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE COIN OR OTHER PRODUCT GIVING RISE TO THE CLAIM, OR (B) $100. THESE LIMITATIONS DO NOT APPLY TO LIABILITY ARISING FROM OUR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT, OR FOR DEATH OR PERSONAL INJURY, OR TO ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
29. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Austin Rare Coins Parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms; (b) your violation of any law or the rights of any third party; (c) your User Content; or (d) any false statement you make to us regarding your identity, payment, or ownership of coins you sell to us. This Section does not require you to indemnify any Austin Rare Coins Party for its own negligence or misconduct.
30. Time Limits on Claims
No claim may be filed by a customer in connection with a particular coin more than one year after that coin was purchased by the customer regardless of when the customer became aware of the claim. Any other claim arising out of or relating to these Terms or the Website must be commenced within one year after the claim arises. Claims not brought within these periods are permanently barred, to the fullest extent permitted by applicable law.
31. Governing Law and Venue
These Terms and all Transactions are performable in Travis County, Texas, and are governed by the laws of the State of Texas and applicable federal law, without regard to conflict of law principles. Subject to Section 32, any action or proceeding arising out of or relating to these Terms, the Website, or any Transaction must be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of and venue in those courts.
32. Dispute Resolution; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
(a) Informal Resolution. Before starting an arbitration or small claims action, you and Austin Rare Coins agree to try to resolve any dispute informally. The party with a dispute must send the other party a written notice (“Dispute Notice”) that includes the party’s name, address, email address, and telephone number, a description of the dispute (including any order number), and the relief requested. Dispute Notices to us must be sent to Austin Rare Coins, Inc., Attn: Legal, 13809 Research Blvd, Suite 405, Austin, Texas 78750, or [email protected]. The parties will negotiate in good faith for 60 days after the Dispute Notice is received. Any applicable time limit for bringing a claim is tolled during this period.
(b) Agreement to Arbitrate. If a dispute is not resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or any Transaction between you and Austin Rare Coins, Inc. (“Claims”) will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules, or if AAA determines they are applicable, its Consumer Arbitration Rules, in each case as modified by this Section (the “AAA Rules”). The AAA Rules are available at www.adr.org. The arbitration will be conducted by a single arbitrator in Travis County, Texas, or, at your election, by telephone or videoconference. Payment of AAA filing, administration, and arbitrator fees will be governed by the AAA Rules. The arbitrator may award the same individual relief that a court could award, and judgment on the award may be entered in any court having jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
(c) Class Action Waiver. YOU AND AUSTIN RARE COINS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. EXCEPT AS PROVIDED IN SUBSECTION (d), THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND UNENFORCEABLE AS TO ANY CLAIM, THAT CLAIM WILL BE DECIDED BY A COURT IN ACCORDANCE WITH SECTION 31, AND NOT IN ARBITRATION.
(d) Mass Arbitration. If five or more Dispute Notices or demands for arbitration raising similar Claims are submitted by or with the assistance of the same or coordinated counsel, the Claims will be administered in batches of up to 10 Claims each, with only one batch proceeding at a time, and the remaining Claims (and the associated filing fees) held in abeyance until the prior batch is resolved. To the extent permitted by the AAA Rules, each batch will be assigned to a single arbitrator. The parties will engage in a single global mediation of all remaining Claims after the first batch is resolved. Any applicable time limit for bringing a Claim is tolled while a Claim is held in abeyance under this subsection.
(e) Exceptions. Either party may bring an individual action in small claims court for Claims within the court’s jurisdiction, and either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
(f) Jury Trial Waiver. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IF ANY CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND AUSTIN RARE COINS EACH WAIVE THE RIGHT TO A JURY TRIAL.
(g) Opt-Out. You may opt out of this Section by sending written notice, including your name, address, and a clear statement that you wish to opt out of arbitration, to [email protected] or to the mailing address in subsection (a) within 30 days after you first accept these Terms. If you opt out, Claims will be resolved in accordance with Section 31. Opting out will not affect any other part of these Terms.
(h) Survival. This Section survives the termination of these Terms and the completion of any Transaction.
33. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, labor disputes, governmental action, war, terrorism, market suspensions or extraordinary market disruptions, supply shortages, carrier delays, power failures, or internet or telecommunications failures.
34. Assignment
You may not assign or transfer these Terms or any rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction. These Terms bind and benefit the parties and their respective successors and permitted assigns.
35. Waiver and Severability
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision, and no waiver will be deemed a continuing waiver. If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect, except as provided in Section 32(c).
36. Entire Agreement
These Terms, our Privacy Policy, our Shipping Information page, and any written order confirmation or invoice we issue for a Transaction constitute the entire agreement between you and Austin Rare Coins regarding the Website and your Transactions, and supersede all prior understandings regarding those subjects. If a written order confirmation or invoice we issue conflicts with these Terms, the order confirmation or invoice controls for that Transaction.
